We wrote these to be read, not skimmed past. They cover two things: how this website works, and how borrowing from Cheez works. Your loan agreement itself is a separate document that you sign, and where anything here differs from your signed agreement or the National Credit Act, those win.
1Who we are
Cheez is a trading name of [Company name (Pty) Ltd], registration number [registration number], a registered credit provider with NCR registration number [NCRCP00000]. Our registered address is [address]. You can reach us at [phone] or [email]. This is the disclosure required by section 43 of the Electronic Communications and Transactions Act.
2These terms
By using this website you accept these terms. The website is information and marketing. Nothing on it is an offer of credit, and the calculator shows estimates based on our standard pricing. Credit is only offered in a pre-agreement quote made to you personally after an affordability assessment, as the National Credit Act requires.
3Who can borrow
You must be 18 or older, hold a South African ID, have a regular income, and have a bank account in your own name. Every application goes through an affordability assessment. We do not and may not guarantee approval, and any agent or advert that promises guaranteed approval is not speaking for us.
4Your quote comes first
Before you sign anything, you receive a pre-agreement statement and quote showing the loan amount, every fee, the interest, the total you will repay, and the dates. Those numbers are binding on us. If what you are asked to sign differs from your quote, do not sign it, and tell us.
5Interest and fees
We charge interest at 5% a month, a once-off initiation fee, and a monthly service fee, all within the maximums set by the National Credit Act for short-term credit, with VAT included where it applies. Interest at Cheez never compounds. If interest goes unpaid, it waits as arrears and does not earn interest of its own.
6Repaying your slice
You repay in the fixed amounts and on the dates in your agreement. Payments are applied first to arrears interest, then to the current month's interest, then to the loan itself. You may settle early at any time under section 125 of the National Credit Act, and you pay interest only up to the day you settle.
If you are going to miss a date, contact us before it arrives and we will work out the month together. Missed payments sit as arrears and may be reported to registered credit bureaux as the law provides. We collect what is owed through lawful channels only.
7Extending a month
You can ask to extend your loan by a month before your repayment date. An extension carries that month's interest and service fee only. The initiation fee is charged once per loan, never again on an extension.
8Our agents
Cheez loans are arranged through authorised Cheez agents. An agent acts for Cheez when taking your application and paying out your loan. An agent may never charge you a fee to submit or approve an application, and never ask you to pay cash to secure a loan. If anyone does, they are not acting for us. Report it to [phone or email] and do not pay.
9Your information
To assess and run your loan we collect your name, ID number, contact details, income information, and bank details. We use them for the affordability assessment, your loan agreement, payments, and the records the law requires us to keep. We protect your information as the Protection of Personal Information Act requires, we do not sell it, and we share it only with the parties needed to run your loan, such as payment providers and credit bureaux. You may ask us what we hold about you, ask us to correct it, or complain to the Information Regulator.
10This website
We keep the site accurate and available, but it is provided as is. Figures on it are estimates until they appear in your quote. The Cheez name, mark, and content belong to us; you may not copy or pass them off. Links to other sites are for convenience, and we are not responsible for what you find there.
11What we are liable for
We are liable for what the National Credit Act, the Consumer Protection Act, and our signed agreements make us liable for, and nothing in these terms takes away a right those laws give you. Beyond that, we are not liable for loss caused by using this website, by downtime, or by services outside our control, to the extent the law allows us to say so.
12If something goes wrong
Talk to us first at [phone or email] and give us the chance to fix it. If we do not resolve your complaint, you may take it to the National Credit Regulator (www.ncr.org.za, 0860 627 627) or the Credit Ombud (www.creditombud.org.za, 0861 662 837). Using them costs you nothing.
13Changes and law
We may update these terms, and the date at the top always tells you when we last did. Changes never apply backwards to a loan you have already signed. These terms are governed by South African law, and if any part of them is found invalid, the rest still stands.
